ABORTION

"No person is required to perform or participate in medical procedures which result in abortion, and refusal to perform or participate in the medical procedures is not grounds for civil liability nor a basis for disciplinary or other recriminatory action." ORC § 4731.91  (D)

"No private hospital, private hospital director, or governing board of a private hospital is required to permit an abortion." ORC § 4731.91  (A)

"No public hospital, public hospital director, or governing board of a public hospital is required to permit an abortion." ORC § 4731.91  (B)

"Refusal to permit an abortion is not grounds for civil liability nor a basis for disciplinary or other recriminatory action." ORC § 4731.91  (C)

No person shall be ordered by a public agency or any person to submit to an abortion." ORC § 5101.55  (A)

All abortions are required to be reported to the Department of Health, as well as complications arising from an abortion. OAC § 3701-47-03

There are no restrictions on where an abortion can be performed if the conceptus has developed less than fourteen (14) weeks from the first day of the woman's last menstrual period.

A fetus is "the developing conceptus from fourteen (14) weeks after the first day of the woman's last menstrual period until birth." OAC § 3701-47-01  (E)

If an abortion involves a fetus, then "immediate post abortion care shall be provided in a hospital." OAC § 3701-47-02  (A)

An "appropriate certificate of birth shall be made out after the twentieth (20th) week of gestation." OAC § 3701-47-03  (E)

"State or local public funds shall not be used to subsidize an abortion, unless the abortion is necessary to preserve the life or physical or mental health of the pregnant woman and this fact is certified in writing by the performing physician to the state or local agency providing the funds." ORC § 5101.55  (C)

The Public Health Council may adopt rules relating to abortions.  ORC § 3701.341

Violation of these rules is grounds for discipline.  ORC § 4731.22  (B)
