ARTIFICIAL INSEMINATIONAny body fluid donated for injection into another person, including semen, shall be given an HIV test before being injected to determine that the fluid is not infected with the HIV virus unless, in an emergency, the recipient of the donation or his guardian, after consultation with the recipient's physician, consents to a waiver of this requirement. ORC § 3701.246 ORC Sections 3111.30 - 3111.38 deal with non-spousal artificial insemination for the purpose of impregnating a woman so she can bear a child that she intends to raise as her child. These sections do not deal with the artificial insemination of a wife with the semen of her husband or with surrogate motherhood. There are informed consent and confidentiality requirements unique to artificial insemination cases which are contained in these sections of the law.
