BLOOD DONATION AND TRANSFUSION

Any body fluid donated for transfusion or injection into another person, including blood, plasma, a blood product or other fluid, shall be given an HIV test before being transfused or injected to determine that the fluid is not infected with the HIV virus unless, in an emergency, the recipient of the donation or his guardian, after consultation with the recipient's physician, consents to a waiver of this requirement. ORC § 3701.246

"No person, with knowledge that he is a carrier of a virus that causes acquired immune deficiency syndrome, shall sell or donate his blood, plasma, or a product of his blood, if he knows or should know the blood, plasma, or product of his blood is being accepted for the purpose of transfusion to another individual. Whoever violates this section is guilty of selling or donating contaminated blood, a felony of the third degree." ORC § 2927.13
