DECEASED'S ESTATE, CLAIMS AGAINST

Claims against the estate of a deceased person should be presented within three months after the appointment of the executor or administrator.

Presentment after three months from the appointment results in a lower priority attaching to the debt.

Physician's fees may rank fifth, ninth or tenth in priority. Expenses of the last sickness of the decedent receive fifth priority. ORC § 2117.25 (E) Claims presented within three months from the appointment of an executor or administrator receive ninth priority and claims presented after the three month period receive tenth priority. Debts in each priority class are paid until the money runs out; if this should happen before the obligations of a particular class are satisfied, the debts within the class are prorated among the creditors according to the amount of their obligations. ORC § 2117.25
