FREESTANDING EMERGENCY FACILITY

"Freestanding emergency facility" means any facility other than a hospital-based emergency department that accepts patients from ambulance delivery on a regular basis or otherwise holds itself out as accepting or treating life -or -limb -threatening emergencies or employs the word "emergency" in its name or title. ORC § 3702.51

Each freestanding emergency facility shall be open at all times. Medical care at the freestanding emergency facility shall be under the direction of an allopathic or osteopathic physician who is board eligible in emergency medicine or who is board eligible in internal medicine, family practice or surgery with additional training in emergency and/or critical care. OAC § 3701-12-31

A physician shall be on the premises of each freestanding emergency facility at all times and shall promptly conduct initial patient assessments on all patients who are brought to the freestanding emergency facility. OAC § 3701-12-31

Each freestanding emergency facility must assure the necessary transportation of its patients by ambulance, or otherwise, with appropriate life support capabilities, including an EMT-A and attending nurse. A freestanding emergency facility must have transfer agreements with other health care facilities and physicians who will accept referral of patients. OAC § 3701-12-31
