NURSE AIDE"Nurse aide' means an individual who provides nursing and nursing related services to patients or residents in a long-term care facility, other than a licensed health professional or an individual who provides nursing and nursing related services as a volunteer without monetary compensation."

§ "Nothing in sections 3721.27 to 3721.33 of the Revised Code shall be construed to permit any individual to engage in the practice of nursing as a registered nurse or the practice of nursing as a licensed practical nurse if the individual does not hold a valid certificate or license." ORC § 3721.271 (Amended and renumbered RC § 3721.35 in H 822. Eff 12-13-90.) Each nurse aide working in a long-term care facility on a full-time, temporary, per diem, or other basis on July 1, 1989, shall be provided by the facility a competency evaluation program conducted or approved by the Director of Health. Effective January 1, 1990, no long-term care facility shall use an individual as a nurse aide for more than four months unless the individual is competent to provide the services he is to provide, the facility has received from the nurse aide registration in the Department of Health the information concerning the individual, and the individual has successfully completed a designated competency evaluation program. ORC § 3721.28 Effective January 1, 1990, no long-term care facility shall use for longer than four months an individual who successfully completed a competency evaluation program, but has not functioned as a nurse aide for twenty-four consecutive months, unless the individual has completed additional training and competency evaluation.
