BIRTH CERTIFICATES

For the reporting of vital statistics, "Live birth' means the complete expulsion or extraction from its mother of a product of human conception that after such expulsion or extraction breathes or shows any other evidence of life such as beating of the heart, pulsation of the umbilical cord, or definite movement of voluntary muscles, whether or not the umbilical cord has been cut or the placenta is attached." ORC § 3705.01 (A)

"A birth certificate for each live birth in this state shall be filed in the registration district in which it occurs within ten (10) days after such birth..." ORC § 3705.09 (A)

"When a birth occurs in or en route to an institution, the person in charge of the institution...shall obtain the personal data, prepare the certificate, secure the signatures required, and file the certificate within ten (10) days...The physician in attendance shall provide the medical information required by the certificate and certify to the facts of birth within seventy-two (72) hours after the birth." ORC § 3705.09 (B)

"When a birth occurs outside an institution, the birth certificate shall be prepared and filed by one of the following in the indicated order of priority:

  1. the physician in attendance at or immediately after the birth;
  2. any other person in attendance at or immediately after the birth;
  3. the father;
  4. the mother;
  5. the person in charge of the premises where the birth occurred." ORC § 3705.09 (C)

"Any birth certificate submitted for filing eleven (11) or more days after the birth occurred constitutes a delayed birth registration..." ORC § 3705.10

"Information contained in the Information for Medical and Health Use Only' section of a birth record shall not be included as part of a certified copy of the birth record unless the information specifically is requested by the individual to whose birth the record attests, either of his parents or his guardian, a lineal descendant, or an official of the federal or state government or of a political subdivision of the state charged by law with detecting
or prosecuting crime. Except as provided above, neither the Office of Vital Statistics nor a local registrar shall disclose information contained in the Information for Medical and Health Use Only' section of a birth record unless a court, for good cause shown, orders disclosure of the information..." ORC § 3705.23 (A)

DEATH CERTIFICATES

For the reporting of vital statistics, "Fetal death' means death prior to the complete expulsion or extraction from its mother of a product of human conception of at least twenty (20) weeks of gestation, which after such expulsion or extraction does not breathe or show any other evidence of life such as beating of the heart, pulsation of the umbilical cord, or definite movement of voluntary muscles." ORC § 3705.01 (B)

"Each death or fetal death that occurs in this state shall be registered with the local registrar of vital statistics of the district in which the death or fetal death occurred by the funeral director or other person in charge of the final disposition of the remains." ORC § 3705.16

"The medical certificate of death shall be completed and signed by the physician who attended the deceased or by the coroner within forty-eight (48) hours after death." ORC § 3705.16

"When the medical certification as to the cause of death cannot be provided by the attending physician or coroner prior to burial, for sufficient cause...the funeral director may file a provisional death certificate... Such funeral director shall file a satisfactory and complete death certificate within five days after the date of death...A burial permit authorizing cremation shall not be issued upon the filing of a provisional certificate of death." ORC § 3705.17
